This Privacy Policy governs the manner in which FLY SHOP Europe collects, uses, maintains and discloses information collected from users (each, a "User") of the www.flyshopeurope.com website ("Site"). This privacy policy applies to the Site and all products and services offered by FLY SHOP Europe. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle information from Users. The Site is owned by the limited liability Company, FS Europe s.r.o., Tatranska 1234/6, 040 01 Kosice, Slovakia, Business Identification Number: 51334852, Tax Identification Number (VAT ID): SK2120682938, Jurisdiction: Kosice, Slovakia.

Personal data collected by FLY SHOP Europe via the Site are processed in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter also referred to as GDPR. FLY SHOP Europe does not disclose buyers information to third parties.

Personal identification information

We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, fill out a form, respond to a survey, subscribe to the newsletter and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, credit card information. Users may, however, visit our Site anonymously.

We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.

Non-personal identification information

We may collect non-personal identification information about Users whenever they interact with our Site. Personal data of Customers are collected in case of:

1) registration of an account in the Online Store for the purpose of establishment and management of an individual account. Legal grounds: processing is necessary for the performance of a contract on establishment and management of an Account service (article 6 sec. 1 letter b of GDPR);

2) subscription of the Newsletter for the purpose of the performance of a contract concerning a service rendered by electronic means. Legal grounds: consent of a data subject for the performance of a contract concerning Newsletter service (article 6 sec. 1 letter a of GDPR); we use your email address outside of contractual processing exclusively to send you a newsletter for our own marketing purposes, if you have explicitly agreed to this. The processing will be carried out on the basis of art. 6 (1) lit. a GDPR with your consent. You can withdraw your consent at any time without affecting the legality of the processing carried out with your consent up to the withdrawal. You can unsubscribe from the newsletter at any time using the relevant link in the newsletter or by contacting us. Your email address will then be removed from the distributor. Your data will be forwarded to a service provider for email marketing in the course of order processing. It will not be forwarded to other third parties. Your data will be transferred to a third country, which is covered by an adequacy decision by the European Commission. 3) use of the contact form service for the purpose of the performance of a contract executed by electronic means. Legal grounds: processing is necessary for the performance of a contract on contact form services (article 6 sec. 1 letter b of GDPR).

Communication with the shipping provider

We forward your email address to the shipping company in the course of contractual processing, if you have explicitly agreed to this in the order process. The forwarding is for the purpose of informing you by email on the shipping status of your order. The processing will be carried out on the basis of art. 6 (1) lit. a GDPR with your consent. You can withdraw your consent at any time by contacting us or the transport company without affecting the legality of the processing carried out with your consent up to the withdrawal. Shipping provider are: Slovenska posta, a.s., and GLS Slovakia s.r.o.

Collection and use of personal data 

When you submit an order we only collect and use your personal data insofar as this is necessary for the fulfilment and handling of your order as well as processing of your queries. The provision of data is necessary for conclusion of a contract. Failure to provide it will prevent the conclusion of any contract. The processing will occur on the basis of Article 6(1) b) GDPR and is required for the fulfilment of a contract with you.  

Your data is transferred here for example to the shipping companies and dropshipping providers, payment service providers, service providers for handling the order and IT service providers that you have selected. We will comply strictly with legal requirements in every case. The scope of data transmission is restricted to a minimum.

Our website uses the reCAPTCHA service by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) is the data controller responsible for your data if you have your habitual residence in the European Economic Area or Switzerland. Google Ireland Limited is therefore the company affiliated with Google which is responsible for processing your data and for compliance with applicable data protection laws.

The request serves to distinguish whether the input was made by a human or automatic machine processing. For this purpose your input will be transmitted to Google and used by them further. In addition, the IP address and any other data required by Google for the reCAPTCHA service will be transferred to Google. This data will be processed by Google within the EU and potentially also in the USA. Transmission of data to the USA is covered by an adequacy decision by the European Commission, the “Privacy Shield”. Google participates in “Privacy Shield” and has submitted to its requirements. 

Facebook remarketing

Our website uses the remarketing function "Custom Audiences" by Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA; "Facebook"). This application serves to address the visitor to the website with interest-related advertising on the social network Facebook. We have implemented Facebook’s remarketing tag on our website for this purpose. This tag sets up a direct connection to Facebook’s servers when you visit our website. This informs the Facebook server which of our web pages you have visited. Facebook assigns this information to your personal Facebook user account. When you visit the social network Facebook you will then be shown personalised, interest-related Facebook ads. Your data may be transmitted to the USA. To process transactions - We may use the information Users provide about themselves when placing an order only to provide service to that order. We do not share this information with outside parties except to the extent necessary to provide the service.

The processing of data enables us to offer you the option of paying via the PayPal payment service. To integrate this payment service it is essential that PayPal collects, stores, and analyses data when you access the website (e.g. IP address, device type, operating system, browser type, device location). On grounds relating to your particular situation, you have the right to object at any time to this processing of personal data concerning you and carried out in accordance with Article 6(1)(f) GDPR. By selecting and using "PayPal", the data required for payment processing will be submitted to PayPal to execute the agreement with you using the selected payment method. The data is processed on the basis of Article 6(1)(b) GDPR.

To administer a content, promotion, survey or other Site feature - To send Users information they agreed to receive about topics we think will be of interest to them.

To send periodic emails - The email address Users provide for order processing, will only be used to send them information and updates pertaining to their order. It may also be used to respond to their inquiries, and/or other requests or questions. If User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related product or service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or User may contact us via our Site.
